Restrictive Dietary Licensing Legislation
Say bye bye to nutrient dense dietary advice and hello to the ADA (American Dietetic Association) processed foods protocols. This bill creates a nutrition and dietary monopoly for Registered Dietitians. They already have a monopoly in hospitals, schools and nursing homes. Wisconsin is struggling with a $6.5 billion deficit. The last thing Wisconsin needs is to incur costs prosecuting “food lawbreakers” and shutting down businesses.

Dietitian bill will destroy practices

SUAMICO — I am urging everyone who cares about nutrition and good health to oppose the Wisconsin Dietitians Licensing Bill.
With certain exceptions, the bill "prohibits a person who is not a licensed dietitian from practicing dietetics or nutrition care services."
This bill will destroy the practice of hundreds of certified nutritionists, naturopathic doctors, and the many others who offer nutritional services. Health food stores as well would be prohibited from giving specific nutritional advice.
This bill says that only licensed dietitians are uniquely qualified to give nutritional advice. There are thousands of Wisconsin citizens using alternative nutritional services who are benefiting from nutritional advice that helps them live healthier.
The movement toward more wholesome foods, the benefits of organics, the use of supplements and herbs to improve health does not come from certified dietitians. It comes from the thousands of consumers and the hundreds of practitioners of natural and alternative health and nutrition.
One only has to look at hospital food and school lunches to appreciate what dietitians consider nutritious. We oppose the concept that dietitians should be the only state-sanctioned authority for all nutritional services. Visit your local health food store for more information.

- Includes exclusionary language preventing alternative nutrition providers.
Bill: "3) a retailer that furnishes oral or written general nutrition information about food and other goods; "
Leg Council "These exemptions are intended to make this legislation less exclusive, they don’t provide immunity to retailers or other unlicensed nutritionists, unless they are only providing “general information.” However, there is no definition of “general information” in the bill so there is some ambiguity there as well." )
Bill: "current law prohibits a person who is not certified by the board from designating himself or herself as a dietitian, claiming to provide dietetic services, or using any title or initial that would represent that person as certified or licensed as a dietitian or in a nutrition−related field."

February 20, 2009 --Sen Vinehout & Rep Pasch sign on as Sponsors to WDA (Wisconsin Dietetic Association) licensing bill without meeting constituents to hear opposition.
This legislation would create a dietary and nutrition monopoly for registered dietitians so they can collect Medicare insurance. The Standard American Diet (SAD) would become the "law" in Wisconsin. "Health" guidelines for this trade organization includes margarine, aspartame, vaccine screening and fluoride . No discussion of raw food, Weston A. Price nutrition, Eat Right for Your Blood Type, Diets for Autism, etc, would be allowed.
- Friday, February 20, Vinehout and Pasch sent a letter to all Wisconsin legislators asking to co-sponsor the WDA licensing bill.
- Both had agreed to a March 4 meeting to hear WIHFC opposition and to attend constituent meetings to hear citizen opposition before sponsorship of the bill.
- Letter sent to legislators states "proposal does not restrict." Click here to see new bill which has same language as 2008 bill Requires training from ADA approved schools, a bachelor's, master's, or doctoral degree.
- Strategy: legislators will not read bill and co-sponsor on the basis of the introduction letter.
- Call your legislators this week (click here to find your legislator) and ask them not to co-sponsor Vinehout and Pasch's request for WDA (Wisconsin Dietetic Association) licensing bill
- Call you legislators to schedule district meetings to voice your opposition. Gather many for the meetings, citizens and practitioners.
- It is OK now to publish this widely, newspapers, radio, talk shows, etc.
- **Let me know of legislators who supports the WDA bill.** We will invite them to the March 4 meeting in Madison with our Lobbyist and one of our members. Example: Jon Erpenbach's office. Jon thinks this bill is necessary to protect seniors who are being given expensive nutritional supplements as a last ditch effort to keep them alive if they have cancer, etc.

Exemptions from licensure
Current law exempts a person who is licensed or certified and lawfully
practicing as any of the following from obtaining certification from the board
provided the person practices within the scope of his or her license or certificate and
does not claim to be a dietitian or licensed in a nutrition-related field: nurses,
chiropractors, dentists, physicians, physical therapists, podiatrists, athletic
trainers, occupational therapists, optometrists, pharmacists, acupuncturists,
nursing home administrators, and persons to whom a practice or procedure is
delegated by any of the above.

(a) Assessing the nutritional needs of an individual or group of individuals
based upon biochemical, anthropometric, physical, and dietary data; determining

group of individuals; and recommending proper nutrition intake to satisfy those
needs.
(b) Establishing priorities, goals, and objectives to meet the nutritional needs
of the individual or group of individuals based on available resources and
constraints.
(c) Providing nutrition counseling to an individual or group of individuals
regarding health and disease.
(d) Evaluating, adjusting, and maintaining standards of quality in dietetics
and nutrition care services.

The WDA bill is on hold until Jolene, our contract lobbyist, makes a presentation to WDA Sponsor Senator Kathleen Vinehout (D) and the legislative attorney on how the WDA bill will impact Wisconsin businesses.
No Assembly WDA sponsor can be found at this time.
Jolene needs at least six statements (short, concise with bullets points) from health food stores or practitioners on how the WDA bill will impact their business. Each statement will be analyzed by the legislative attorney.
Jolene wanted names and addresses and I explained some business are somewhat underground and do not want to draw attention to themselves. So we settled on no names or detailed addresses.

Special Interests Groups Lobbying to Deny Citizen's Constitution Rights on Natural Health Care and Nutrition
In the waning hours of the 2008 Wisconsinlegislative session, WDA lobbyists whispered in lawmakersears: "This bill will protect the public." Many lawmakers did not read the billand blindly sponsored this legislation. Wisconsin Lawmakers use the "rule of 300." For every constituent call they receive equals 300 constituents that share the same opinion. Citizens jammed the phone lines with NO calls for the WDA Licensure Bill. The bill never made it to the floor for a vote thanks to citizens response.
